A Kingston man will serve one to three years in state prison after pleading guilty to criminally negligent homicide in connection with the death of his 6-month-old daughter, who was left alone in a bathtub with running water.

The Ulster County District Attorney's office said Ashante Inniss, 28, of Kingston, pleaded guilty to the felony charge on Thursday in Ulster County Court.

According to the district attorney's office, Inniss left his daughter unattended in a bathtub with running water for approximately 25 minutes on April 18, 2020. When he returned to the bathtub, he found his daughter floating on the water and immediately called 911.

Kingston police officers who responded attempted CPR but were unable to save the baby. Inniss was arrested later that evening and charged with criminally negligent homicide.

Inniss also pleaded guilty to a second, unrelated felony, first-degree criminal contempt. That charge stemmed from an alleged domestic violence incident on Nov. 10, 2020 during which Inniss was accused of slashing his girlfriend's tires and of being in her presence while she had a full stay-away order of protection against him.

Ulster County Court Judge Bryan Rounds also sentenced Inniss to one to three years in state prison on the contempt charge. The sentences are to run concurrently.

Royce Russell, an attorney who represented Inniss, said that as the head of the family's household, his client "took responsibility for his negligence" and was "remorseful" about what happened.
